Terms of Service

By accessing or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

The minimum age to use the Service is 13 years old, or the digital age of consent in your country if that is higher. If you are under 18 (or the age of majority in your jurisdiction), you may only use the Service with the involvement, supervision, and consent of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service. To independently agree to these Terms and enter into a binding subscription, you must have reached the age of legal consent under the applicable law of your country, generally 18 or the age of majority where you live.

You agree to provide accurate, current, and complete information when creating your account, and to keep that information up to date. You are solely responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at info@trendshiftlabs.com if you suspect unauthorized use of your account.

• All payments are securely processed by Creem.io, which acts as the Merchant of Record for all subscriptions purchased through the Service. Creem.io is responsible for payment processing, invoicing, and applicable tax collection and remittance.
• Subscriptions are billed in advance on a monthly or annual basis and automatically renew for successive periods of the same length unless you cancel before the next billing date.
• You can cancel your subscription at any time from Manage account in the studio. Cancellation takes effect at the end of your current billing period, and you retain access to the Service until then.
• Prices, plans, and included credits are described on our Pricing page and may change from time to time; we will provide reasonable notice of any price increase before it applies to you.

Refunds

All payments are final and non-refundable once a billing period begins, including partially used periods, except where required by applicable law. Because generating content through the Service consumes real compute costs immediately upon use, we do not offer refunds or credits for unused subscription periods, unused credits, or dissatisfaction with generated outputs. If you believe you were charged in error, contact us at info@trendshiftlabs.com and we will review your case.

You agree not to, and not to permit anyone else to:

• Access or attempt to access the Service by any means other than the interfaces we provide, including scraping, crawling, or automated data extraction.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, models, or underlying technology of the Service.
• Probe, scan, or test the vulnerability of the Service, or breach or circumvent any security or authentication measures.
• Use the Service to generate content that is illegal, infringing, defamatory, harassing, or that depicts child sexual abuse material, non-consensual intimate imagery, or otherwise violates applicable law or third-party rights.
• Use the Service to impersonate any person or entity, or to generate misleading synthetic media intended to deceive.
• Interfere with, overload, or disrupt the Service, its servers, or networks, including through excessive automated requests.
• Resell, sublicense, or provide access to the Service to third parties without our prior written consent.

We reserve the right to review, restrict, or remove any content that violates this Acceptable Use policy, and to take action against accounts that violate it, as described in Section 6 (Termination).

The Service, including our software, model integrations, branding, logos, and website design, is owned by trendshiftlabs and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property, other than the limited right to use the Service in accordance with these Terms.

As between you and trendshiftlabs, and subject to your compliance with these Terms and payment of applicable fees, you own the outputs you generate through the Service using your own prompts and uploaded content. You are responsible for ensuring you have the necessary rights to any material you upload, and for how you use any generated output, including complying with the usage terms of the underlying AI model providers where applicable.

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms, misuse the Service, fail to pay applicable fees, or if we are required to do so by law. You may stop using the Service and cancel your subscription at any time. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED OUTPUTS MAY BE INACCURATE, UNEXPECTED, OR UNSUITABLE FOR A PARTICULAR PURPOSE, AND YOU ARE RESPONSIBLE FOR REVIEWING OUTPUTS BEFORE RELYING ON OR DISTRIBUTING THEM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDSHIFTLABS AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above limitations may not apply to you in full.

You agree to indemnify and hold trendshiftlabs harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

These Terms are governed by the laws applicable to international digital commerce and cross-border SaaS agreements, consistent with the jurisdiction of our Merchant of Record and payment infrastructure (the European Union / Estonia) and our operating base. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the competent courts in that jurisdiction, except where applicable consumer-protection law entitles you to bring a claim in your own country of residence.

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
